The Bodyke Evictions: Disturbances and Distress

Transcription of Colonel O’Callaghan's summons to appear in court over the wrongful seizure of Darby Tuohy’s livestock.

No 1. County Courts, Ireland.
County of Clare
Division of Ennis + Ennistymon
Darby Tuohy
of Curragosee
in the County of Clare Farmer Plaintiff;
Colonel John O’Callaghan
of Maryfort O’Callaghan’s Mills
and Stannard McAdam
having an office or place of
business at Clonlara
both in the said County and Division
Defendants.

By the County Court Judge.
The Defendants are hereby required
personally to appear at the County Court to be
held at Ennis in the
said County, on the Plaintiff’s Bill for £25
for that the Defendants
by their bailiffs on the 3rd
day of May 1893 wrongfully
and illegally seized and
and afterwards sold a two
year colt plaintiffs
property under a writ of
Fieri Facias at the suit of Defendant Colonel John
OCallaghan against one Martin Moloney.
And for the price or value of said colt so illegally seized + sold as aforesaid.
And for damages for that the Defendants by their bailiffs
In the month of April 1893 wrongfully and illegally
Seized 3 two year old heifers 1 two year old bullock and
1 three year old bullock plaintiffs property under the
aforesaid writ of Fieri Facias.
